On June 18, 2024, President Biden announced that certain undocumented immigrants married to U.S. citizens will now be eligible to apply for parole in place. This use of existing legal authority aims to offer relief, support, and opportunities to hundreds of thousands of mixed-status American families across the United States.
To qualify for this relief, individuals must:
- Be married to a U.S. citizen
- Have lived in the U.S. for at least ten years
- Have originally entered the U.S. without admission or parole
- Meet any other applicable legal requirements
Eligible individuals will also be able to apply for protection for their children. Applicants must submit supporting evidence to demonstrate they meet these criteria and pay a fee. Each application will be considered on a case-by-case basis.
Recipients will be protected from deportation and can apply for work authorization, similar to successful programs such as military parole in place or DACA. These protections and work permits will generally last for up to three years, with the possibility of renewal in the future.
