Understanding the new USCIS deference policy that revokes the long-standing guidance issued during the Trump administration during 2004. The earlier guidance required treatment of the H1-B, L1 and other employment-based nonimmigrant visa extensions as a new application. This treatment under the previous policy required applicants to submit more additional documents ( also known as Request for evidence – RFE ) and increased the administrative cost for the employers and the chances of denial in some cases.
