What is the H1-B Program?

The H-1 B visa program is a US government program for US employers seeking to hire non-immigrants as workers/employees in a speciality occupation. The law defines a speciality occupation as one that requires the application of a body of highly specialised knowledge requiring at least a bachelor’s degree or equivalent.

Every year, the program offers a stipulated number of new H-1 B visas, amounting to 85,000, which USCIS issues for each financial year starting on 1st Oct, which any employer can use.

H1-B visa quota for FY 2027

The number of new H-1 B visas for fiscal 2027 that USCIS will issue will fall into two categories: the regular quota (for beneficiaries with a bachelor’s degree) and the other for master’s degree holders. Since there is a limit on the number of new visas issued in any fiscal year, it is called the H-1 B cap.

  • March 4, 2026: Registration Period Opens — Employers began submitting electronic registrations for the lottery at 12:00 PM ET.

  • March 31, 2026: Selection Notifications — USCIS finished the random selection process and notified “Selected” registrants via their online accounts.
  • April 1, 2026: Petition Filing Window Opens — Selected employers began filing the full H-1B petitions (Form I-129).
  • June 30, 2026: Standard Filing Deadline — Typically, the end of the initial 90-day window to file a petition for those selected in the first round.
  • October 1, 2027: Earliest Employment Start Date — The official beginning of Fiscal Year 2026 and the earliest day a selected worker could start in H-1B status.

Key H-1B Questions

A US employer can sponsor an H1B visa for a foreign worker. The employer must demonstrate a need for a foreign worker in a speciality occupation and that the foreign worker is qualified for the job.

The H-1B visa cap is the annual numerical limit on the number of H-1B visas issued by the US government each fiscal year. Congress established the cap to regulate the number of foreign workers who can enter the US on H-1 B visas. The Regular Cap is set at 65000 per fiscal year, and 20000 is the Master’s Cap.

The Application fee for the H-1B Cap season 2027 consists of two components: the standard USCIS fee and the new Supplemental fee, which took effect in September 2025 as part of the Presidential Proclamation. The Supplemental fee applies only to immigrants who have no lawful immigration status in the US under the Immigration & Nationality Act.
The standard or base fee is determined by the employer’s size: $2280 per petition for employers with 25 or fewer permanent employees, and $3610 per petition for those with 26 or more permanent employees. The employer can avail a $50 discount if the petition is filed online.
The new supplemental fee of $ 100,000 is only applicable to Consular processing cases.

The H-1B lottery selection method was random, but a single registrant was counted once, even if the registrant participated in the lottery under the same employer under different job roles. The Passport Number determines each registrant’s uniqueness.

The lottery selection rule in the H-1B cap season 2027 is much different. The new selection method is called the Weighted selection. It is a wage-weighted selection method. However, this method retains the beneficiary’s uniqueness, as in the old method and also gives greater weight to candidates applying for H-1B roles with higher salaries.
