H1B Visa Attorney Florida

the H-1B allows dual intent, unlike the Student visa that does not allow you to have the intention to immigrate.

In Florida, the economy is thriving which leads to the growth of new jobs at a rapid rate. With the emergence of multiple opportunities, there are more job positions for workers from other countries. For entering the country to legally work, you need to apply for an H-1B visa.

H1-B visas are for people who can get employment from U.S. organizations. Their jobs require particular expertise. Many of the jobs are in the IT, Health Care, and Science areas. The jobs that need a minimum of a Bachelor’s degree come under the H-1B visa. This visa authorizes holders to retain dual intent status: working temporarily, continuing permanently. While an H1B is being maintained, the holder can choose to continue living in the U.S. for the long term.

How Can An H1-B Visa Attorney In Florida Benefit?

There aren’t many visas that can match the rage of the H-1B. Numerous immigrants apply for this visa every year because of its portability, dual intent status, and reasonably low conditions. It is important to know what the H-1B requirements are before starting the filing procedure to avoid any unwanted errors or uncertainties. The immigration process is long and costly. If you apply for a visa and it goes wrong, all your efforts are ruined. And while there is no guarantee you can receive a visa; you can work with an H1B Visa attorney in Florida to boost your chances.

H1B Visa Attorneys in Florida can help you explain more about the procedure. You may learn how likely you are to obtain the visa. Similarly, you may find out about several visas that are best suited for your requirements. You can get to know if it might be a short waiting period or other likelihoods of a successful result.

How To Choose The Best H1B visa attorney in Florida?

  • Profound Experience in H1B:
Not all U.S. immigration attorneys are well-experienced in the H1B Visa principles. Some immigration attorneys concentrate entirely on family immigration, while other attorneys may focus their practice on other issues. You should not directly choose any of the available H1-B Visa Attorneys in Florida. You should find out about any potential lawyer whether or not he/she is experienced with the H1B procedure. Open communication and make sure that you are satisfied with the prospective lawyer. The attorney should be addressing your introductory questions about H1B Visa and should give you an understanding of the strength of your case.
  • Can Association With AILA help?:
H1B visa law is highly twisted. It is significant for any attorney you’re considering to be informed on immigration law. The attorney must keep up with immigration laws and trends. It’s really important to find a H1-B Visa Attorney in Florida who is a member of AILA (American Immigration Lawyers Association). Being an AILA member naturally indicates that the lawyer dedicates all or a large portion of his/her practice to immigration law.

This implies that visa holders are permitted to apply for and obtain a green card during their stay. Of course, there is no guarantee you will receive a green card. The primary criterion for a person’s eligibility for an H1B visa is to have a valid job offer from a US Employer, in a speciality occupation that requires specialized knowledge and the minimum of a bachelor’s degree in that specific speciality. The beneficiary should have a bachelor’s degree or equivalent in the specific speciality.

The work authorization under an H1B visa is strictly limited to employment by the sponsoring employer. For a visa holder to stay in status, he has to be continuously employed with the employer and should be engaged in a speciality occupation. The issuance of an H1B visa is given initially for three years.

USCIS issues the visa initially for three years, and your employer can request an extension for three more years. The person has to be continuously employed by the employer to stay in status and leave the country otherwise. If one is switching to a different employer, the new employer should  file a petition on your behalf. In certain circumstances an extension can be granted for more than 6 years.

The extension of an H1B visa is possible multiple times, subject to the condition the holder remains eligible as per immigration guidelines. The extension can be given beyond 6 years if the beneficiary has an I-140 Immigrant petition approval or if the Labor Certification or I-140 is pending for a period of 365 days.

The standard fee for H1B I-129 filing is $460. There may be other fees associated with the petition also, depending on the number of employees and if the company is H-1 be dependent, this could bring the fees up to over $2,000.

It refers to the period when the F-1 change of status to H-1b is pending. During this time the USCIS grants the same benefits to the F-1 student that they had at the time of filing of the H-1b petition, even though that F-1 status might expire after filing, because of the long wait for processing of the H-1b and the fact that the H-1b cap is valid from October 1 of that year, the start of the new Fiscal year, petitions are usually filed 6 months in advance.

Employers like certain Universities, non-profits and government research organizations are exempt from the H1B cap as they can file for H1B applications with USCIS at any point in time.

No, the H-1b visa does not automatically lead to a Green Card. H1B visa holders are eligible to file a green card through their employer or through certain types of family relationships.
