Hi madam, I’m F4 Greencard applicant. My priority date was 8th Nov 2011. My son, who will turn 21 years old by Nov 18th, 2025. According to USCIS immigration law, dependents who reach the age of 21 may become ineligible for a green card, potentially impacting their immigration status. Could you please advise us on the feasibility of expediting the process or adjustment of status to mitigate the risk of my son.
The priority date for F4 is currently 15 Jan 2006. If you filed in 2011 you have a long wait. Since your child ages out next year you might not be able to include him unless he is protected by CSPA, based on which they will deduct the time taken to approve the I-130 from the child’s age, but that might not be enough in this case as the wait is long.
