I am no longer with the employer(A) on whose name I have the approved I140. Been working with the current employer(B) to get started on my GC/Perm process, but not much success. So started to look around and found another employer(C) who is willing to begin GC process asap. When C filed for an H1 transfer, received an RFE that PD has been current for more than 365 days why I am not filing 485. Concerns… 1) Is there an issue in getting the H1 transfer with C? 2)Since I have not applied for more than 365days, will I lose my place in the line? Thanks
Yes it could be an issue getting your I-94 extended beyond 6 years as that law permits extension only if your have an I-140 approved and your priority date is not yet current. Your priority date can be transferred to another I-140 approval even if you have not filed your I-485 for 365 days.
