I was recently laid off from my job, and my last day of employment, as per the severance package agreement I received, is March 22, 2024. However, my employer has agreed to continue providing me with paychecks for the next 12 weeks, until June 14, 2024, as part of the severance package. My concern is regarding the USCIS 60-day grace period. I understand that the grace period typically begins on the day after an individual’s formal last day of employment. In my case, would the 60-day grace period start from March 22, 2024, or from June 15, 2024? Additionally, my employer has requested my support for the work I was doing at the company during this period, and they have added an exhibit to the severance package agreement specifying this arrangement. I am also unsure about the description that will appear on the paychecks I will receive during this period. Would the description of these paychecks have any implications for the USCIS 60-day grace period?
The 60 days grace is counted from the last day of employment and any paid vacation that you might have. If severance package end date can be considered as end date is a grey area but most probably not, however if the pay appears as a normal check and you are still working for them during that person you might be able to consider the latter date as you last day.
