I’m on H4 and going through some rough phase on my married life with my husband(on H1b). what options do I’ve to safeguard my status in US and do i need his consent to change status? Can he either now or during my COS processing can influence USCIS to not approve my petition?

You can file for a change of status to a B-2 ( visitor) or F-1 (student ). You would have to submit your marriage certificate, your spouses H-1 approval and paystubs. If you don’t have the approval and paystubs it’s possible to explain the same to USCIS. No your husband cannot influence this process.
