Registration is the first step for employers seeking to participate in the H-1B Cap-subject petition for fiscal year 2027. Remember, not all registrations will receive H-1B status, as there is a limit on the number of H-1B visas that USCIS issues in each fiscal year. The limit for the fiscal year 2027 is 65000 people holding a bachelor’s degree and 20000 people holding an advanced degree, such as a Master’s or PhD.
Since there is a limit on the number of visas issued in each fiscal year, USCIS conducts a lottery based on employer registrations for each prospective employee under each cap. ( Here, the cap refers to the limits on bachelor’s or advanced degree candidates)
Two important definitions:
Registrant or Petitioner: The Employer who will file the H-1B petition for the fiscal year 2027 is called the Registrant. Since the H-1B is a work visa, the employer is responsible for filing the petition for all prospective employees they want to bring to the U.S. to work for them.
Beneficiary: The prospective employee for whom the employer files the H-1B petition for the Cap season 2027. It is their educational qualification that will determine whether the petition filed falls under Bachelor’s or Master’s Cap.
The Process of Filing H-1B Registration for Cap Season 2027
Step 1: Create an Organizational account
You can use either a business or personal email ID (such as Google or Yahoo) to open this account. However, we recommend using a business email, as this process is typically employer-related and may require verification tied to your business identity.
Remember, if you already have an account. You can use the same one.
Points to remember:
- The email ID that you use to open the account becomes the administrator of the organizational account. One can only use business email IDs to open this account; one can’t use email IDs ending with Gmail, Yahoo, etc.
- The administrator can invite other coworkers to the organizational account as users. To add a coworker, log in to the USCIS account, go to the My Company tab, and select “Manage Company Group.”
- The administrator can assign the administrator role to multiple coworkers. It is always advised to have at least two administrators for any company’s USCIS account.
If you want an immigration attorney to file registrations on the company’s behalf, the administrator needs to send the attorney an invitation. To send an invitation to the attorney, go to the “My Representatives” tab inside the organizational account and send an invitation. Always use the attorney’s full name and the email address the attorney uses for their business correspondence. Make sure that a USCIS legal representative account exists against the attorney’s email ID.( Remember, the attorney needs to submit the Form G-28 or the Notice of appearance for the inviting company )
Step 2 : Gather Information
After the account opening process is complete and before you start filing registrations against different beneficiaries, they should be prepared with the following set of information
- Employer Info: It includes the employer’s legal name, EIN (Employer Identification Number), and the primary U.S. office.
- Beneficiary info: Legal name, date of birth, country of birth, and country of citizenship for all beneficiaries (as shown on their passports). The employer intends to file for registration in the Cap Season 2027.
- Passport details: A valid passport or travel documents of all the beneficiaries are essential. Remember, an employer can file only one petition against a specific passport number.
- Education details: Information on the educational qualifications of the various beneficiaries is necessary. Whether they have a Bachelor’s degree or a US Master’s degree is essential information that USCIS will consider when determining whether to include them in the lottery under a different cap. Beneficiaries with a Master’s degree have the benefit of being considered under both bachelor’s and Master’s caps.
- SOC details: During registration for the Cap Season 2027, the employer must also provide the Standard Occupational Classification (SOC) codes and the intended employment areas for the job profile for which they are considering a particular beneficiary.
Step 3: Submission of the registration
Once you have gathered all the information about the beneficiary, job profiles, and the employer, it is time to file the registration. The employer or their legal representative needs to file the registration between 4th March 2026 and 19th March 2026, during which the registration window will remain open under the Organizational account.
Registration fee: The registration filing fee is $216 per beneficiary. The fee is non-refundable, even if the beneficiary is selected in the Cap Season 2027 lottery.

Looking at previous cap seasons, wage levels have never mattered in H-1 B lottery selection, but for FY 2027, they will. Under the new Weighted selection process for H-1B registrants that took effect on 29th Dec 2025, if more than one employer files the registration then uscis will take into consideration the employer with the lower wage level for registration purposes, so that employers do not try to game the system. In the current registrations, Employer B will receive greater preference in the lottery selection process; therefore, it is advisable to conduct an audit of job roles based on SOC codes.
