The lottery result declaration is the second step of the H-1B journey for the Cap season 2027. Post-registration, USCIS conducts a lottery to filter out all the beneficiaries for whom any employer has filed the registration. The H-1B lottery is the process by which USCIS selects from the list of registered beneficiaries who qualify to move to the next step in their H-1B Application. During the process, USCIS selects more beneficiaries than the number of H-1B visas stipulated for each fiscal year. The additional selection is done because there might be a risk that some registrations will be rejected or disqualified, or that employers will opt out of the next step.
H-1B lottery selection process for Cap season 2027
The process by which a particular registration is selected in the H-1B lottery is not random but structured. Two factors guide the selection process:
- Uniqueness of the beneficiary, which is defined by their passport number. A beneficiary-centric system that ensures that every passport number will be considered once in the lottery pool. In case an employer wants to trick the system by filing multiple registrations against the same beneficiary, the USCIS H-1B lottery system will consider that as invalid.
- The weighted wage level is a new factor introduced for the H-1B Cap Season 2027. The new system considers a beneficiary who falls under the highest wage level (i.e., four) to receive four entries into the lottery pool. This additional increase increases the probability of selection for beneficiaries falling in the higher wage level by 61%.
A serious point to remember is that beneficiaries who registered under the Master Cap also get a double chance of participating in the H-1B lottery for the Cap season 2027, one under the Bachelor’s Cap and another under the Master’s Cap.

As Employers, you all know that the H-1B Registration process is entirely online using the organizational account, so the USCIS notifies you about the selection through the same.
To check the status of your registration, the employer or their representative can log in to the online portal (https://my.uscis.gov/). There are different statuses with their corresponding meaning:
- Selected: It means the employer must file the H-1B application for the specific beneficiary with this status within 90 days.
- Submitted: This status means that registration has not been selected in the current lottery, but is not disqualified. The particular registration may be considered in forthcoming H-1B Cap Season 2027 lotteries, if that happens.
- Denied: This status means USCIS disqualifies the registration. It can happen if the employer has filed multiple registrations for the same beneficiaries, which is considered fraud.
- Invalidated: This status indicates that the $215 employer fee paid at the time of registering a beneficiary was not reconciled, so the registration was not accepted into the H-1B lottery pool for Cap Season 2027.

A beneficiary who participates in the H-1B lottery process for the Cap Season 2027 with multiple registrations from different employers may harm their success probability because of the new weighted selection rules, which work over the factor of beneficiary centricity. In the Cap Season 2027, USCIS is using an AI-driven cross-referencing system to flag “acting in concert”. Say, in case more than one employer files registration on your behalf for substantially similar roles under Level 1 or 2, it might trigger NOID ( Notice of Intent to Deny).
The short answer to this question is Yes. As per H-1B guidelines, the beneficiary doesn’t need to have secured their bachelor’s or master’s degree at the time of filing the registration and participating in the lottery. The employer can file the registration based on “Expected Degree.” The degree becomes relevant when the employer files the H-1B application after the lottery selection. For the Cap season 2027, remember to have the degree ready by 1st April 2026.
The wage level is an essential factor affecting the selection of any registration in the lottery of the Cap Season 2027. A higher wage level definitely increases the probability of success, and registering with a high wage level will yield more entries in the lottery pool. Wage level 4 has the highest chance at 61%, followed by level 3 at 45%, level 2 at 30%, and level 1 at the lowest opportunity of 15%.
As per the current rule, the $215 registration fee is to be paid by the employer or petitioner. The new statutory fee of $100,000 has been paid after a registration is picked in the H-1B lottery for the Cap Season 2027 and before the employer files the final application. The new fee applies only to cases where the beneficiary holds no status under US Immigration law (i.e., consular processing cases).
It is not easy to predict whether USCIS will conduct any 2nd or 3rd H-1B lottery. USCIS decides that this only occurs after the initial 90 days have elapsed and the results of the 1st lottery are announced. If USCIS determines that applications filed for beneficiaries who were successful in the 1st lottery are insufficient to meet the Cap numbers (65000 for bachelor’s and 20000 for master’s), it will conduct an additional lottery.
